Britney Spears’ Father Argues ‘No Grounds’ for Removal from Conservatorship

In a court filing, Britney Spears’ father argued that there are “no grounds whatsoever” for his dismissal from his daughter’s conservatorship.

James Spears “has dutifully and faithfully served as the conservator of his daughter’s estate without any blemishes on his record,” the filing submitted on Friday reads. The filing also alleges that Jodi Montgomery, the conservator of her person, sought his help dealing with his daughter’s mental health issues.

Britney Spears and her lawyer maintain that her father “misrepresented and manipulated” the call to use it to his advantage. Spears’ newly chosen lawyer Mathew Rosengart is attempting to get Spears’ father removed from the 13-year arrangement.

Rosengart cited the allegations made by his client at her hearings in June and July. Those allegations included forced medical treatment and therapy, improper medical care, limitations on personal rights, and more.

But Spears argues that Jodi Montgomery is responsible for his daughter’s health and wellbeing. Spears says he received a call from Montgomery on July 9 in regards to his daughter’s health.

“Ms. Montgomery sounded very distraught and expressed how concerned she was about my daughters’ recent behavior and overall mental health,” Spears wrote in a personal declaration included with the court filing.

“Ms. Montgomery explained that my daughter was not timely or properly taking her medications, was not listening to the recommendations of her medical team, and refused to even see some of her doctors. Ms. Montgomery said she was very worried about the direction my daughter was heading in and directly asked for my help to address these issues.”

But Jodi Montgomery herself paints the call to Britney Spears father in a different light.

“The concern that Ms. Montgomery did raise to Mr. Spears during their telephone call is that forcing Ms. Spears to take the stand to testify or to have her evaluated would move the needle in the wrong direction for her mental health,” the statement continues.

Montgomery says, “having her father Jamie Spears continuing to serve as conservator instead of a neutral professional fiduciary is having a serious impact on Ms. Spears’ mental health.” She also says the call is being misrepresented by Mr. Spears to gain some sort of tactical advantage to pre-empt the proceedings to remove him from the arrangement.

A hearing to address the recently filed petition to remove James Spears is scheduled for September 29.
